Definitions . oo For purposes of this agreement, "Commission" means the United States Atomic Energy Corzission or any duly authorized representative thereof and "Agency" means or any duly authorized representative thereof. Costs Chargeable to Commissicn Funds Subject to limitations and conditions specified in the letter agreemen incorporating this Avpendix, the Asency may-charge the Commission, exc as otherwise provided in Articles VIIE and IX hereof, the actuaily incurred costs necessary or incident to the performance of the werk, except that no charge shall be made for general administrative or central egency overhead except to the extent otherwise provided in the jetter agreement. III. Financing . . a a Upon presentation by the Agency of proper vouchers, the Commission wil? reimburse the Agency for costs ectuaily ineurred on Conmission work subject to any limitations on costs otherwise provided in tnis agr ment. Requests for reimbursement shall show separately the amount be reimbursed for (a) operating costs, (vb) capital ecui as defi in VIII below) and (c) acquisition or condemnation of any real propert; or any facility or for plant or facility acquisition, cons truction or expansion. Notice of Costs Anproaching Tovel Estim2 ted Costs : Whenever the Agency has reascn to believe that the total cost of the work under this agreement will be substantially greater or less than th ‘presently estimated cost of the work, the Agency shall promptiy notify the Commission in writing. The Agency shall aiso notify the Coralssicn in Weitins, when the desregate of costs incurred and cutstanding commitments auicwable under this agreement is equal to ninety percent (90%) (or such other vercentase as the Commission may from time to time establisn by notice to the Agency) of the presently estimated total costs under this agreenent.
