10. The Contractor does not, however, rely on continued funding beyond any fiscal year for which an Appropriation Act has been passed and shall not be able to assert a claim for any type of damage arising out of or caused by the failure of the Nitijela to appropriate moneys. G. The parties agree that as soon as reasonably practical, and, in any event no later than completion of the transition period they shall agree on the level of funding for all activities of the Ministry at the date of execution of this agreement. Scheduleattached and incorporated herein sets forth the mutual understanding of the parties with respect to funds presentiy being expended but shall not be deemed conclusive or binding.
