Following verbatim text telegram contains proposed Japanese

revision of third paragraph draft US note (EMBTET. 1257 as
modified by DEPTEL 1101). Foreign Office accepts draft notes
in all other respects, and states its revistons not intended
affect substance US proposals.

Japanese now willing accept concept re "act of grace" and

language on, "question | of legal liability".

They prefer, how-

ever, term "ex gratia” for "act of grace",
since latter when
translated into Japanese implies degree of US superiority,
whereas "ex gratia"; following precedent in administrative
agreement, will not be translated into comparable Japanese
expression.

Foreign Office also points out that its phrase "csompen- .

sation to Japanese nationals" is consistent with our second

paragraph where US avers it prepared make "compensation".

Appears Japanese have accepted substance US position and
therefore recommend approval.
